Terms of Service

In the following Terms of Service (TOS), the use of first-person pronouns such as “I,” “me,” “my,” etc. refers to King Boudica, LLC, and artist/owner Becca Rey Kendrick interchangeably. The use of “you,” “your,” “yours,” etc. refers to the client. By submitting a request for commissioned artwork, you assert that you have read, understand, and agree to the TOS as described below. Updated Nov. 17, 2024.

Usage and Expectations

  • Commissioned artwork produced by King Boudica, LLC, or artist/owner Becca Rey Kendrick is for personal use only. Artwork may be used for profile pictures, profile banners, reference images or other personal uses, but may not otherwise be used for financial gain, including but not limited to: online, video or print advertising; merchandising; resale; etc. Commercial use rates available upon request only at this time. I own and retain all rights to artwork I produce.

  • I retain the option to edit and/or post any artwork I produce on my public social media as I see fit unless specifically requested and agreed upon before work has begun on the project. Posting, reposting, and sharing the artwork on social media is allowed only with credit to @kingboudica, King Boudica, LLC, or Becca Rey Kendrick, especially the signature/watermark is not visible for any reason.

  • Tracing, copying, and/or editing my artwork is strictly prohibited. Furthermore, using my work with any Artificial Intelligence (AI) engine, Non Fungible Token (NFT) or any other crypto-currency related transactions, in any way, shape, or form is strictly prohibited.

  • I retain the right to decline a project if I feel that my skill level may not meet your expectations or if the request falls under subjects or themes I am not comfortable portraying or being associated with. Such subjects and themes include but are not limited to: frontal nudity/depiction of genitals; sexually explicit and/or violent content; "Lolita,” “Loli,” or other minor-coded content; excessive gore; racist, sexist, transphobic, homophobic, and/or xenophobic stereotypes, dogwhistles, and/or caricatures. If you are unsure if a request may fall into any of these prohibited categories, please ask.

  • Please wait patiently for your commission to be finished; I have a physical disability and my primary income is a 8-5 Monday-Friday job, so most of my artwork time is relegated to evenings and weekends, when I am well enough to do so. Allow up to four (4) weeks from the date of full payment for completion unless otherwise specified. I typically provide watermarked updates at the planning/sketching stage, work-in-progress/rendering stage, and revision stage. You may request additional updates, but I only guarantee one update per week.

  • Provide a minimum of three (3) specific visual references and a detailed written description of your request. Providing these references and descriptions helps me guarantee that I can better fulfill your request and avoid unnecessary mistakes and revisions. Please do not provide AI-generated or NSFW reference images.

  • Be courteous and professional. Please allow up to three (3) days for responses via Direct Messages (DMs) or email. Any spamming, harassment, disrespectful or otherwise inappropriate behavior towards me at any point during the process will not be tolerated and will result in immediate cancelation of the commissioned project.

Pricing, Payment, and Cancellation

  • Prices listed on the Commissions Page are in $USD and reflect the base prices for digitally painted artworks created in Clip Studio Paint and/or Procreate. No physical product will be produced or delivered unless prints or traditional artwork (graphite, ink, and/or acrylic on paper) is specifically requested (additional materials and shipping fees will apply). Prices may increase based on factors included but not limited to composition complexity, number of characters/figures, level of detail, image size, expedited deadlines, and are figured and applied on a case-by-case basis.

  • A 25% nonrefundable deposit is required upon my acceptance of the commission project, and payable via Square invoice only. Do not send any funds until the commission has been explicitly accepted by me, nor through any other payment method. Funds sent outside of both parties’ explicit agreement will be treated as tips/donations and will not be refunded. No work will be started until the deposit has been paid.

  • All payments must be made through Square. An invoice will be sent to the provided email once the project is accepted. A deposit of at least 25% must be paid before I start working on the project. Once the sketch/planning phase is approved by the client, the remaining balance must be paid in full within 10 days before I continue working on your project. If the remaining balance has not been paid in full within the allotted timeframe without sufficient communication, the commissioned project will be considered canceled and no refund will be issued.

  • If for any reason you need to cancel your commissioned project after paying the 25% nonrefundable deposit but before I have moved on to the rendering stage, I can offer a partial refund for any payment exceeding the 25% nonrefundable deposit, up to 75% of the total.

  • After I have received approval of the sketch phase and begun working on the remainder of the project, refunds will not be offered except under extenuating circumstances and only at my discretion.

  • In the rare event that I am for any reason unable complete the project within a reasonable and agreed upon amount of time, I can offer a partial refund for any payment exceeding the 25% nonrefundable deposit, up to 75% of the total.

Process

  • Within one (1) week of the deposit being paid, I will send at least one (1) watermarked progress image of the sketch phase for you to review and either approve or request revision. You will then need to pay the remaining balance before I proceed with rendering the project.

  • When I have finished the first render of the project, I will send a watermarked image for your review. At which point, up to three (3) minor revisions may be requested. More than three (3) minor revisions or any major revisions may incur an additional fee that must be paid in full before I proceed to make the requested adjustments. The definitions of “minor revision” and “major revision” vary and will be applied on a case-by-case basis.

  • Once the finalized artwork is accepted, I will email you high resolution (300dpi standard unless otherwise requested) copies of the project file in .jpg, .png, .pdf, .csp, and/or .psd format as agreed upon, as well as a 30-second .mp4 time lapse recording if requested. If the file(s) exceed the 25mb attachment limit, alternative methods of delivery will be discussed.

By submitting a commission project request, you assert that you have read, understand, and agree to the Terms of Service as described above and on the invoice(s).
